Assam Orders Deportation of Declared Foreigner to Bangladesh Under 1950 Law
In a significant development in Assam's ongoing drive against illegal immigration, the Biswanath district administration has ordered the deportation of a man declared a foreigner by a Foreigners' Tribunal , directing him to leave for Bangladesh under the provisions of the Immigrants (Expulsion from Assam) Act, 1950 .
The order, issued by District Magistrate Karabi Saikia Karan , pertains to Kayam Ansari , a resident of Kherbari village in Sonitpur district. According to a report submitted by the Superintendent of Police (Border), Biswanath , Ansari was declared a Bangladeshi citizen and a foreigner by a Foreigners' Tribunal after due legal proceedings.
Authorities said Ansari has been lodged at the Matia Transit Camp in Goalpara district since his arrest on May 28, 2025 . The district administration noted that no appeals, writ petitions, or other legal proceedings are currently pending against him, leaving no legal impediment to his deportation.
Under the order issued on Thursday, Ansari has been directed to leave Assam and proceed to Bangladesh through the Sribhumi, Dhubri, or South Salmara border within 24 hours of receiving the notice. The administration warned that if he fails to comply, authorities will initiate forceful deportation in accordance with the law.
The Superintendent of Police (Border) has been instructed to complete the deportation process immediately with the assistance of the concerned authorities. The District Election Officer has also been directed to remove the individual's name from the electoral roll, if it appears there, while the Revenue Department has been asked to take action regarding his movable and immovable properties, if required under existing legal provisions.
The case comes amid Assam's continued efforts to identify and deport declared foreigners through the legal framework established under the Foreigners Act, 1946 , the Foreigners' Tribunals Order , and the Immigrants (Expulsion from Assam) Act, 1950 . Individuals suspected of being illegal migrants are referred to Foreigners' Tribunals , which determine their citizenship status after examining evidence. Once a person is declared a foreigner and all legal remedies are exhausted, the state government may initiate deportation proceedings, subject to applicable laws and coordination with the receiving country.
