Delhi Court Grants Bail To Former Minister Satyendar Jain In Delhi Jal Board Corruption Case

A Delhi court on Thursday granted bail to AAP leader and former Delhi minister Satyendar Jain in the Delhi Jal Board (DJB) corruption case, holding that the material currently available was “prima facie insufficient” to deny him relief.

Special Judge Dig Vinay Singh criticised the Anti-Corruption Branch (ACB) over the 27-month delay between registration of the FIR in May 2024 and Jain’s arrest in August 2026. The court noted that Jain had joined the investigation and the agency had not identified any new or intervening circumstance that made his physical custody necessary after such a prolonged period.

The judge observed that when an accused has cooperated with an investigation for years, a sudden arrest at the tail end of the investigation without strong reasons can invite criticism that the action was arbitrary. The court also stressed that pre-trial detention cannot be allowed to become an advanced form of punitive punishment.

The case relates to a tender awarded to Euroteck Environmental Private Limited when Jain was Delhi’s water minister. The ACB has alleged that tender conditions were manipulated to favour the company.

The court said the prosecution’s case primarily rests on documentary and electronic evidence, including official notes, files, technical proposals and bank statements, much of which had already been seized. It also noted that the ACB did not seek police custody after Jain’s arrest, indicating that active custodial interrogation was not required.

The judge found that WhatsApp chats did not prima facie link Jain to alleged kickbacks or hawala transactions, while no phone calls or SMS messages presently established such a connection. The court also noted that the contracts were awarded in July 2022, after Jain had been arrested in another case.

While some of Jain’s decisions “raise eyebrows”, the court said they were not sufficient at the bail stage to establish culpability, which must ultimately be tested at trial.

The court held that Jain satisfied the “triple test” for bail, finding no flight risk or likelihood of tampering with evidence or influencing witnesses. He was directed to furnish a ₹2 lakh personal bond with two sureties, surrender his passport, seek permission before leaving the country and continue cooperating with the investigation.
