
Expired Eggs, Spoiled Baby Food? Why FSSAI Sent 9 Notices To Swiggy Instamart
The Food Safety and Standards Authority of India has issued nine notices to Swiggy Instamart after receiving multiple consumer complaints alleging violations under the Food Safety and Standards Act 2006. The regulator confirmed the action in a post on X , stating that complaints alleged the supply of expired, spoiled, rotten, contaminated and otherwise unsafe food products through the quick commerce platform.
Among the flagged incidents, an infant food formulation was reportedly found in a highly deteriorated and unsafe condition, showing signs of contamination and improper storage. FSSAI stated that even after the product was returned, it was allegedly re-supplied to the consumer. Other complaints cited the delivery of contaminated eggs and milk along with damaged packaged food items. An Akshayakalpa organic egg was reportedly found expired and emitting a foul odour, while a Kakke da Paratha product was allegedly spoiled and unfit for consumption, with no corrective action taken despite the complaint being escalated.
The regulator also flagged licensing irregularities, noting that eggs were allegedly marketed under a brand name not covered under the product categories approved in the existing FSSAI licence. The food business operator has been directed not to market the product unless it falls under a valid licence and to apply for a licence modification if required. FSSAI further noted that some products, including a whey protein supplement and a namkeen mixture, were allegedly supplied after their expiry dates, and that certain listings showed incorrect or non-existent licence numbers, with food business entities operating under names different from those registered against their FSSAI licence.
FSSAI said some complaints alleged that no satisfactory response or grievance redressal was provided even after being escalated, while in one instance only a refund was offered without addressing the underlying food safety concern. The notices stem from both suo motu cognisance by the regulator and direct consumer complaints. Swiggy Instamart has been directed to submit a detailed explanation along with a compliance report covering its food safety systems, quality control measures and corrective actions, failing which the regulator has warned of legal action under the Food Safety and Standards Act .
