ICE Shooting Of Man In New York With Child In His Car Sparks Outrage

A 28-year-old Dominican national, Oscar Belgal, was shot in the neck by US Immigration and Customs Enforcement (ICE) officers in New York’s Marble Hill neighbourhood on October 8, while a five-year-old child was inside his car. The incident has sparked protests, demands for accountability and a legal challenge over his detention, intensifying tensions between federal authorities and New York’s Democratic leadership.

The shooting occurred around 4 pm when federal officers attempted to arrest Belgal. New York Police Department (NYPD) Commissioner Jessica Tisch said an officer fired seven rounds, striking him below his left ear. NYPD body-camera footage released after the incident shows Belgal handcuffed and bleeding as officers arrange medical assistance, but it does not capture the shooting itself.

Federal officials claimed Belgal accelerated towards officers and struck government vehicles while attempting to escape. Homeland Security Secretary Markwayne Mullin defended the officers, saying they believed their lives were in danger and did not know a child was in the car. However, surveillance footage showed plainclothes officers approaching Belgal’s vehicle with guns drawn. The available footage did not establish the government’s allegation that he rammed their vehicles, leaving key details of the confrontation unresolved.

The Department of Homeland Security said Belgal had a previous grand larceny conviction and other arrests involving assault, robbery, drugs and weapons. Officials also alleged links to the Trinitarios gang, although a revised department statement reportedly removed that reference.

Belgal’s lawyers said a bullet remained lodged in his body and that he continued to experience pain. After struggling to locate him following his hospital transfer, they found him at Brooklyn’s Metropolitan Detention Center. A federal judge ordered that he remain in the New York area while his legal challenge proceeds, restricting his transfer or deportation during the proceedings.

The child was reportedly physically unharmed but visibly shaken. Mayor Zohran Mamdani said he would demand that President Donald Trump end ICE enforcement operations in New York. Governor Kathy Hochul also called for a transparent investigation and the release of federal body-camera footage.

The shooting triggered demonstrations in Marble Hill, with protesters demanding accountability. The Bronx district attorney’s office is investigating the incident. Questions remain over whether the officers’ use of force was justified and what further footage will reveal about the confrontation.
