Maharashtra Polygamy Controversy: Owaisi Distances AIMIM from Sana Malik

A debate over polygamy in the Maharashtra Assembly has snowballed into a national political controversy after NCP (Ajit Pawar faction) MLA Sana Malik defended her views on the issue during the ongoing Monsoon Session. Her remarks have reignited discussions on Muslim Personal Law , women's rights , and the scope of religious freedom under the Indian Constitution .

Reacting to the controversy, AIMIM president and Hyderabad MP Asaduddin Owaisi distanced his party from the issue, saying Sana Malik is fully capable of defending her own statements. He asserted that the matter falls entirely within the domain of the party she represents and that AIMIM has no role in addressing the political fallout.

Speaking to reporters, Owaisi noted that the NCP (Ajit Pawar faction) is ideologically different from AIMIM and is part of the BJP-led National Democratic Alliance (NDA) at the Centre. He said it is for the party leadership to respond to the controversy and explain its legislator's stand. Owaisi also remarked that Malik, as an elected woman representative, has every right and the ability to present and defend her views.

The controversy surfaced during a discussion in the Maharashtra Assembly on women's welfare, family disputes, divorce, and personal laws . As lawmakers debated issues relating to marriage and women's rights, the subject of polygamy was raised, prompting Malik to defend her position. Her comments drew criticism from several legislators, leading to an intense political exchange both inside and outside the Assembly.

Responding to the backlash, Sana Malik argued that issues concerning Muslim women should not be politicised or linked to religion alone. She strongly objected to references made to Pakistan during the debate, stating that Indian Muslims are loyal citizens of India and should not be judged through comparisons with a neighbouring country.

Malik maintained that Muslims in India respect both the Constitution of India and the teachings of the Holy Quran . She said the Constitution guarantees every citizen the freedom to profess and practise their religion, and any discussion on polygamy or reforms to Muslim Personal Law should be guided by constitutional principles and the Quran rather than by examples drawn from Pakistan.

She further asserted that Indian Muslims have no intention of leaving the country and remain committed to living with dignity under the constitutional framework. Her remarks have widened the debate on the relationship between personal laws , gender justice , and constitutional rights , subjects that have frequently surfaced in discussions surrounding proposals such as the Uniform Civil Code (UCC) .

Under India's existing legal framework, Muslim Personal Law permits a Muslim man to marry more than one wife under specific religious conditions, while such practices are prohibited for most other communities under their respective personal laws. The issue has long remained politically sensitive, with supporters of a Uniform Civil Code advocating a common civil law for all citizens, while others argue that any reforms must respect the constitutional protection granted to religious practices.

With political parties taking sharply different positions, the debate has now extended beyond the Maharashtra Assembly, bringing renewed focus to the complex intersection of constitutional freedoms , religious autonomy , and women's rights in India.
